On Thursday, Dec. 14, 2017, Judge Daniel Hovland, U.S. District Court for the District of North Dakota, granted the Assn. of Equipment Manufacturers’ (AEM) request for Preliminary Injunctive relief, which restricts the application of SB 2289 until the case can be fully litigated. 

The North Dakota Implement Dealers Assn. (NDIDA) will continue to fight AEM’s incorrect and inaccurate claims about SB 2289, and remains confident that the North Dakota farm economy will reap the clear benefits contained within SB 2289. NDIDA is currently evaluating whether to appeal Judge Hovland’s Order to the 8th Circuit Court of Appeals. 

According to published reports, a federal judge has ruled that the state of North Dakota cannot enforce “or institute an action for any alleged violation” of a new law designed to protect farm equipment dealers.

The Assn. of Equipment Manufacturers and four equipment manufacturers, including AGCO CORP., CNH Industrial, Deere & Co. and Kubota Tractor Corp., are challenging the law.
