Deere & Co. Drops Lawsuit Against AGCO Corp. Employee

DULUTH, GA — November 19, 2009 — AGCO Corp., manufacturer and distributor of agricultural equipment, announced that Deere & Co. has dismissed a federal lawsuit the company filed last month against current AGCO director of marketing and former Deere sales branch manager, Bill Hurley.

Deere filed suit because Hurley resigned his 21-year position with Deere to accept a position with AGCO. The new position is based at AGCO's corporate headquarters in Duluth, Ga.

Deere agreed to dismiss the case following Hurley's court filings in which he denied he was in possession of any confidential information, and stated that his responsibilities at AGCO Corp. will not be in conflict with any obligations or contractual agreements he had with Deere. Mr. Hurley will continue in his position as director of marketing, with responsibility for 100-horsepower and greater tractors, track and articulated tractors, and seeding/tillage products.
